A source in the Parliament informs the Comments.

According to him, last year the defense applied to the European Court of Human Rights concerning the illegality of the decision of Kyiv Pechers´k District Court from 27 December 2010 on the detention of Yuriy Lutsenko.

´Public hearing before the European Court is scheduled for April 17, for the first time in the history of independent Ukraine it will be considered by the Grand Chamber´, the source stated.

He noted that Lutsenko´s defense filed a lawsuit  regarding a violation of Article 5 of the European Convention on Human Rights.

«In turn, at the initiative of the European Court the Article 18 of the Convention - the so-called political article - was attached to the case´,  said the source.

According to the source, after public hearings, on which Yuriy Lutsenko´s defense will present  the evidence of violations of Ukrainian Justice, European Court will deliberate. ´In practice, it is literally 2-3 days followed by a decision of the European Court. That is, in April European Court may decide the unfair justice in Ukraine», he said.
